The Services are operated by House Haystack, LLC (“House Haystack,” “we,” “us,” or “our”).

Some properties presented through the Services may involve existing financing or another alternative transaction structure.
The Services may include:

Reviewing income, employment, available funds, housing-payment capacity, credit range, and financial history
Identifying general purchasing parameters
Evaluating whether a prospective purchaser may be a potential fit for a property
Communicating potential property opportunities
Connecting prospective purchasers with property owners, sellers, real-estate professionals, and transaction-service providers
Assisting with preliminary transaction coordination
Providing general educational information concerning real-estate transactions
The availability, ownership, financing, condition, location, pricing, entry amount, payment amount, and terms of every property vary.
2. Purchasing Capacity Before Property Matching
House Haystack begins by evaluating preliminary purchasing capacity, not by guaranteeing access to properties.
Submitting information does not mean:
You are approved to purchase a property
You are prequalified or preapproved for a mortgage loan
You have been approved to assume an existing loan
A property has been reserved for you
A seller is required to accept your offer
A lender or loan servicer has approved a transfer
You have entered into a purchase agreement
A transaction will close
House Haystack may decline to present property opportunities when the available information indicates that the proposed payment, available entry funds, reserves, location, timing, intended use, or transaction structure is not a reasonable fit.
House Haystack may also require additional information or documentation before discussing specific properties.
3. Not a Loan Application or Commitment to Lend
Unless expressly stated in a separate written agreement:
The purchasing-capacity form is not a mortgage-loan application.
House Haystack is not a bank, mortgage lender, or loan servicer.
House Haystack is not making a loan commitment.
House Haystack is not issuing a formal mortgage prequalification or preapproval.
House Haystack does not guarantee that financing will be available.
House Haystack does not guarantee that an existing loan may legally or contractually be assumed.
House Haystack does not guarantee approval by a lender, seller, loan servicer, insurer, title company, homeowners’ association, or other party.
No borrower-lender relationship is created by using the Services.
No interest rate, loan balance, monthly payment, entry amount, equity amount, or transaction term is guaranteed until verified and included in final written transaction documents.
When mortgage-lending, loan-origination, brokerage, legal, tax, accounting, insurance, title, escrow, or other regulated services are required, those services must be provided by appropriately qualified or licensed professionals.
4. Alternative Financing and Existing Financing
Some property opportunities may involve alternative financing or the acquisition of property subject to existing financing.
These structures may include:
Acquisition subject to an existing loan
Formal loan assumption
Seller financing
Wraparound financing
Installment land contracts
Lease-option arrangements
Lease-purchase arrangements
Other property-specific financing or acquisition structures
These structures are not interchangeable. Each structure may involve different legal rights, financial obligations, approval requirements, disclosures, risks, and consequences.
A transfer of property ownership does not automatically release an existing borrower from liability under an existing loan.
A lender or loan servicer may retain contractual rights under the existing loan documents, including rights associated with due-on-sale, transfer, default, or acceleration provisions.
Continued payment of an existing loan does not guarantee that a lender or loan servicer will waive or decline to enforce its contractual rights.

A preliminary evaluation based on inaccurate, incomplete, outdated, or misleading information is invalid.
8. Supporting Documentation
House Haystack may request supporting documentation to verify information submitted through the Services.
Requested documents may include:

Tax returns
Bank statements
Asset statements
Housing-payment records
Bankruptcy records
Foreclosure records
Credit-related information
Entity records
Other documents relevant to purchasing capacity or a proposed transaction
Do not provide Social Security numbers, online banking passwords, complete account credentials, or other highly sensitive information unless House Haystack specifically requests it through an approved secure method.
House Haystack may pause or discontinue an evaluation when:
Information cannot be verified
Requested documents are not provided
Documents are incomplete
Information is inconsistent
Information appears false or fraudulent
You stop responding
Your financial circumstances materially change
A property is no longer available
A transaction no longer appears feasible
Continuing the evaluation would create legal, financial, compliance, or operational concerns
Providing false documents or knowingly false information may result in immediate termination of access to the Services and referral to appropriate authorities.
9. Credit Information
Any approximate credit range submitted through the website is self-reported and is not a formal credit determination.
House Haystack will not obtain a consumer credit report unless it first obtains any authorization required by applicable law.
A credit score is only one factor in evaluating purchasing capacity.
Property-specific suitability may also depend on:

House Haystack does not guarantee that a property is:

Free from pests
Free from environmental hazards
Properly permitted
Suitable for occupancy
Suitable for rental use

Financeable
Profitable
You should use appropriately qualified inspectors, contractors, attorneys, title professionals, insurance professionals, and other advisers.
12. Investment Property Risks
Real-estate investment involves substantial risk.
House Haystack does not guarantee:
Property appreciation
Rental income
Occupancy
Tenant performance
Positive cash flow
Tax treatment
Financing availability
Refinancing
Resale value
Repair costs
Operating expenses
Insurance costs

13. No Guarantee of Property Availability
House Haystack does not guarantee:
That any property will be available
That properties will be available in a requested city or county
That a property will meet your criteria
That property information will remain unchanged
That the seller will continue to offer the property
That a property will remain available while your information is reviewed
That another purchaser will not acquire the property
That a property will be suitable for your intended use
Property availability and terms may change or be withdrawn without notice.
14. No Guarantee of Approval or Closing
House Haystack does not guarantee:
That you will qualify for a property
That a seller will approve your terms
That an existing borrower will approve a transaction
That a lender or loan servicer will consent to a transfer or assumption
That a title company will insure the transaction
That an insurer will issue coverage
That required documents can be obtained
That title can be transferred
That financing can be arranged
That an existing loan will remain in place
That monthly payments will remain unchanged
That closing will occur
That possession will be delivered
That a transaction will produce a financial benefit
A transaction is not final until all required agreements have been signed, all conditions have been satisfied, funds have been accepted through an authorized closing process, and title or other applicable rights have been transferred.

16. Funds and Payments

Before transferring money, verify:

House Haystack is not responsible for losses caused by wire fraud, impersonation, compromised accounts, fraudulent instructions, or payments made contrary to verified written instructions, except to the extent liability cannot legally be excluded.
17. Fees and Compensation
House Haystack may receive fees, commissions, referral compensation, marketing fees, consulting fees, transaction-related compensation, or other compensation where permitted by law.
Any fee that you are directly required to pay to House Haystack will be disclosed in a separate written agreement before it becomes due.
House Haystack may also receive compensation from another party involved in a transaction where legally permitted.
The existence of compensation does not guarantee that a transaction is suitable for you.
You remain responsible for independently evaluating the transaction and obtaining professional advice.
18. Third-Party Professionals and Service Providers
House Haystack may introduce or refer you to third-party professionals or service providers.

19. Acceptable Use
You may not:
Use the Services for an unlawful, fraudulent, deceptive, or abusive purpose

25. Indemnification

This obligation does not apply to the extent a claim results from conduct for which indemnification cannot legally be required.

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles.
Property-specific agreements may be governed by the law of the state where the property is located or by another jurisdiction identified in the applicable written agreement.
Any property-specific agreement controls the matters it specifically addresses.
27. Venue
Unless applicable law or a separate written agreement requires otherwise, any legal action arising from these Terms or the Services must be brought in the state or federal courts located in Laramie County, Wyoming.
You consent to the personal jurisdiction and venue of those courts.
28. Changes to These Terms
House Haystack may revise these Terms periodically.
Updated Terms will be posted on this page with a revised “Last Updated” date.
Material changes may also be communicated through the website, email, or another reasonable method.
Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
29. Severability
If a court determines that any provision of these Terms is unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed.
The remaining provisions will remain in effect.
30. No Waiver
Failure by House Haystack to enforce any provision of these Terms does not waive the right to enforce that provision or another provision later.

House Haystack may assign or transfer its rights and obligations in connection with a merger, acquisition, restructuring, sale of assets, financing, or transfer of the Services.
32. Entire Agreement
These Terms and the Privacy Policy constitute the entire website-use agreement between you and House Haystack, except for any separate written agreement governing a specific property, service, or transaction.
A signed purchase agreement, disclosure, financing document, servicing agreement, fee agreement, or other transaction document controls over these Terms regarding the specific subject matter addressed in that document.
